Who we are and why we require your information

Fanagan Group Companies, comprising of Carnegies, Fanagans, Kirwans, Nichols, Quinns and Frank Jennings Funeral Home Funeral Directors, provide a complete funeral service across a broad range of requirements for our clients. To provide the most effective and targeted range of services to meet the needs of our clients, we are required to collect, process and use certain types of information about people and organisations. Depending on the service being sought or provided, the information sought may include 'personal data' as defined by the EU General Data Protection Regulation (GDPR) and may relate to current, past and future service users; past, current and prospective employees; suppliers; and members of the public who may engage in communications with our staff

Why we have a Privacy Statement

This data privacy statement is designed to demonstrate the Fanagan Group Commitment to Privacy, our compliance with the GDPR and to inform you of the personal data we collect and process during and after your engagement with the Fanagan Group.

Please note that under GDPR the definition of personal data only applies to living data subjects.

Our commitment to you is that the personal data you may be required to supply to us is:

  • Obtained and retained for only specified, explicit and legitimate purposes
  • Adequate, relevant and limited to what is necessary for the purpose for which it was obtained

The policy, procedure and management of data in relation to funeral services conducted by us.

Personal data required

Name, address, e-mail address, contact number, mobile number.

Sometimes we will collect other information including details of the deceased including details of their death, details of the grave plot including location of burial ground and details pertaining to cremation.

How do we collect your Data?

You directly provide the Fanagan Group with most of the data we collect. We collect data and process data when you:

  • Contact us by phone or email to arrange funerals or engage with any of our services
  • Order flowers
  • Attend Company organised Stakeholder events and occasions
  • Leave a message of condolence
 

How will we use your data?

  • to expedite all aspects of our funeral-related services in a timely and safe manner
  • to email or call you in relation to all matters prior to, during and after the funeral, and with reference to the payment of the funeral account and the appropriate disposal of cremated ashes
 
 

Client Details:

  • We will only ever ask for the minimum personal data required in order for us to make the arrangements in a suitable manner
  • We retain funeral arrangements information indefinitely. This is to enable us to manage requests from families in the future. It is a vital archive and enables us to function efficiently every day.
  • Advanced Funeral Arrangements: We keep this information in a secure manner. It has been a long tradition in funeral service to hold advanced funeral arrangements details to facilitate the needs of a future client.
  • We do not retain credit and debit card information
 

How is your Personal Data Shared?

  • Your personal data my be disclosed to third parties, where we are legally obliged to do so. It will be disclosed during activities where we have lawful contractual agreements in place that enable the Fanagan Group to function and operate.
 

The Fanagan Group shares your personal data with third-parties and sub-contractors used in the provision of funeral services, such as:

  • Cemeteries and Crematoria
  • Clergy, civil and humanist Celebrants
  • Musicians
  • Printers
  • Sub-contracted funeral operatives
  • Death notice platforms, such as newspapers, radio and RIP.ie
  • Florists
  • Ash Keepsake providers
  • Livestream media companies
  • Catering providers
 

All sub-contractors have been instructed on how to process any personal data we share with them, by keeping the information secure and private and not retaining it for any longer than necessary.

Confirmation of Instructions - Contract for Services

Confirmation of Funeral Instructions and Estimate: All funerals conducted by the Fanagan Group require the client to sign our Confirmation of Instructions and Estimate (a contract to provide funeral services) or give Consent to Proceed by email. This document will contain personal data of the client.

Cookies

Security of Personal Data

We have put in place appropriate measures to ensure your personal data is never lost, used or accessed in an unauthorized way, altered or disclosed. These measures include regular Board review 6 times per year, staff training and awareness and branch audits.

In addition, we limit access to your personal data to those employees, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions.

 

Period for which your personal data will be retained

We will only keep your personal data for as long as is necessary for the purpose for which we are processing it and in accordance with our Record Management & Retention Policy unless we have a legitimate reason for keeping it, for example, any legal requirement to keep the data for a set time period. Where we do not need to continue to process your personal data, it will be securely destroyed.

The Company will hold Personal Data for the time necessary to arrange, conduct and administer final payment of the account, however, we need to hold the funeral arrangement information as part of our archive (an essential tool to function daily) and this archive will have Personal Data contained therein.

Data Breach Notification Process

In the event of an alleged Data breach, the Fanagan Group will follow all procedures as set down by the Data Protection Commission, in particular a commitment by the Company to contact and advise any individuals who may be affected by the alleged Data breach within 48 hours of the notification being made.

 

Your Data Protection Rights

You have the right to request access to personal data held about you, to obtain confirmation as to whether data concerning you exists, to be informed of the content and source of data and to check its accuracy. In addition, if the data held by our company is found to be inaccurate, you have the right to have the data corrected by us.

You may request to have information erased, object to direct marketing and to restrict the processing of your information, including automated decision-making.

You have the right to request data portability (transfer) of personal data held electronically by us to another data controller where technically feasible.

You may withdraw consent at any time where processing is based entirely on your consent. Please note that to help protect your privacy we will take steps to verify your identity before granting access to personal data.

Right of complaint to the Data Protection Commission

If you are not satisfied with the outcome of the response you receive in relation to a data access request or are unhappy with the manner of the processing of your data by Fanagan Group Companies then you are entitled to make a complaint to the Data Protection Commission who may investigate the matter for you.
